Terms
Definitions
Unless the context requires otherwise the following words shall have the following meanings:
"Customer" means the person who views this website and/or purchases Erica Wakerly / Modern Surface Ltd products.
"Contract" means the contract between Erica Wakerly / Modern Surface Ltd and the Customer.
"Products" means the goods ordered by the Customer.
Erica Wakerly / Modern Surface Ltd reserves the right to amend these Terms & Conditions from time to time.
Samples
Samples will be sent by post. Wallpaper and may vary in colour from that seen on your monitor. Wallpapers produced using traditional techniques may result in slight irregularities in the print, but this will not affect the overall finished affect.
Payment
Payment must be received from the customer in full before despatch of orders, unless otherwise agreed with Modern - Wallpaper.
Stock Availability
Erica Wakerly and Polly Dunbar wallpapers are usually all in stock, however this isn't always possible. If an item is out of stock, the Customer will be emailed within 1 working day of placing an order. Please email contact@ericawakerlywallpaper.com if delivery of your order is urgent.
Delivery
Delivery charges will be added to the Customer's order total, or as quoted. Delivery will be by trackable courier. If there is any shortage in delivery or damage to goods in transit, this should be notified to Erica Wakerly / Modern Surface Ltd within 48 hours of delivery. The Products will be delivered to the address provided by the Customer and the Customer must ensure that address details which they provide are accurate. Erica Wakerly / Modern Surface Ltd cannot be held responsible for lost working time or any associated costs in the unlikely event of a delivery being delayed, incorrect, damaged or faulty.
Returns
No goods can be returned without prior arrangement. Please do note the Customer should check all wallpaper products for faults before and during hanging. The Customer should only hang 3 drops before reporting a fault and should contact Erica Wakerly / Modern Surface Ltd immediately if a fault is found. Please note that wallpapers produced to order and cut fabric lengths, are exempt from being returned.
To check colour and quality of the wallpaper and fabrics, please orders samples from us before ordering rolls or lengths.
Sale of Goods
All Products are believed by Erica Wakerly / Modern Surface Ltd to be of a quality suitable for the purpose and specification for which they are intended. Any defect should be reported to Modern - Wallpaper immediately as it is discovered. Hanging guidance will be provided with the Products.
All technical information in response to enquiry is given by Erica Wakerly / Modern Surface Ltd in good faith. It will ultimately be for the Customer to satisfy them self as to the suitability of the product having regard to their own particular situation and upon site conditions that are unknown to Erica Wakerly / Modern Surface Ltd.
The liability of Erica Wakerly / Modern Surface Ltd will not exceed the value of the products supplied. In particular, loss of profits and consequential, financial and other such losses are excluded.
Your Local Laws
The Customer is responsible for any customs duties and/or taxes levied at the point of entry into the destination country. Erica Wakerly / Modern Surface Ltd accepts no responsibility for any delay in clearing the products at customs.
Copyright
All design, text, graphics, and the selection, alteration and arrangement of the aforesaid elements are the copyright of Erica Wakerly / Modern Surface Ltd.
Law
Any contract between Erica Wakerly / Modern Surface Ltd and the Customer will be governed and constructed according to English Law and each party hereby submits to the jurisdiction of the English Courts.
